1. Acceptance of Terms

By accessing and using DripScribe, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service.

2. Service Description

DripScribe provides AI-powered email automation and campaign management services. Our service includes:

• AI-generated email content using OpenAI, Anthropic, and Google Gemini
• Email campaign management and automation
• Integration with Gmail for sending emails on your behalf
• Automatic reply detection to pause email sequences when recipients respond
• Contact list management
• Campaign analytics and reporting

3. Gmail Integration and Google API Usage

3.1 Gmail API Authorization

When you connect your Gmail account:

• You explicitly authorize DripScribe to send emails on your behalf
• You authorize DripScribe to read email threads initiated by our platform to detect when recipients reply
• We access your Gmail account ONLY for sending campaigns you create and detecting replies to those campaigns
• When a reply is detected, we automatically pause the email sequence for that recipient to prevent unwanted follow-up emails
• You can revoke this access at any time through your account settings or Google's permissions page
• We never read your personal emails or access data beyond what's necessary for sending campaigns and detecting replies to those campaigns

3.2 Reply Detection

Our reply detection feature:

• Only monitors email threads that originated from campaigns sent through DripScribe
• Detects that a reply exists—we do not read, store, or analyze reply content
• Automatically pauses scheduled emails when a recipient replies, preventing unwanted follow-ups
• Allows you to manually resume sequences if desired through your dashboard
• Does not access any emails or threads outside of DripScribe-initiated campaigns

3.3 Your Responsibilities with Gmail Integration

You agree that:

• You will not use the service to send emails that violate Google's terms of service
• You understand that excessive bounces or spam complaints may affect your Gmail sending reputation
• You are responsible for maintaining your Gmail account in good standing

4. User Responsibilities

You are responsible for:

• Complying with all applicable anti-spam laws (CAN-SPAM, GDPR, CASL, etc.)
• Only sending emails to contacts who have explicitly consented
• Maintaining accurate account information
• Protecting your account credentials and API access tokens
• Ensuring all content you send is lawful and doesn't infringe on third-party rights
• Monitoring your email sending reputation and bounce rates

5. Prohibited Uses

You may NOT use DripScribe to:

• Send spam, phishing emails, or unsolicited bulk emails
• Violate any laws or regulations
• Harass, abuse, or harm others
• Distribute malware, viruses, or harmful content
• Impersonate others or misrepresent your identity
• Sell or transfer your account access to others
• Attempt to bypass rate limits or system restrictions
• Use the service for any illegal or unauthorized purpose

6. AI-Generated Content

Regarding content generated by our AI features:

• You retain all rights to content you create using our AI tools
• You are responsible for reviewing and approving all AI-generated content before sending
• AI-generated content may not always be accurate or appropriate - human review is essential
• You agree not to use AI features to generate harmful, misleading, or illegal content

7. Payment Terms

7.1 Credit Packages

• Credits are purchased in packages and are non-refundable
• Unused credits do not expire as long as your account remains active
• Credits cannot be transferred between accounts
• Prices may change with 30 days notice for new purchases

7.2 Billing

• All payments are processed securely through Stripe
• You are responsible for all applicable taxes
• Failed payments may result in service suspension

8. Intellectual Property

• DripScribe and its original content, features, and functionality are owned by DripScribe
• You retain ownership of all content you upload or create
• You grant us a license to use your content solely to provide the service
• You may not copy, modify, or reverse engineer any part of our service

9. Privacy and Data Protection

Your use of our service is also governed by our Privacy Policy. By using DripScribe, you agree to our data practices as described in the Privacy Policy.

10. Service Availability and Modifications

• We strive for 99.9% uptime but do not guarantee uninterrupted service
• We may modify or discontinue features with reasonable notice
• We reserve the right to refuse service to anyone for any reason
• Scheduled maintenance will be announced in advance when possible

11. Termination

11.1 Your Right to Terminate

You may close your account at any time through your account settings. Upon termination:

• Your data will be deleted according to our retention policy
• Gmail API access will be immediately revoked
• Unused credits are non-refundable

11.2 Our Right to Terminate

We may suspend or terminate your account immediately for:

• Violation of these Terms of Service
• Violation of our Acceptable Use Policy
• Non-payment of fees
• Suspected fraudulent or illegal activity

To the maximum extent permitted by law:

• DripScribe shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount paid by you in the past 12 months
• We are not responsible for third-party services, including Gmail delivery rates
• We are not liable for loss of data, profits, or business opportunities

You agree to indemnify and hold DripScribe harmless from any claims, damages, or expenses arising from:

• Your violation of these Terms of Service
• Your violation of any third-party rights
• Your use of the service, including content you send
• Any breach of applicable laws or regulations

15. Governing Law

These Terms of Service are governed by the laws of the United States and the State of Florida, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Palm Beach County, Florida.

17. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through the service. Continued use after changes constitutes acceptance of the new terms.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and DripScribe.
